Who we are
Attrly is provided by Attrly LLC, a California limited liability company. By using the site or the platform, you agree to these terms. If you use Attrly for an organization, you confirm you are allowed to accept them on its behalf.
The service
Attrly gives agencies and brands a way to track creator-driven sales on Amazon using Amazon Attribution, and gives creators a portal for their links and results. Attrly is in early access: features may change, and we will tell customers before removing anything they rely on.
Attribution figures come from Amazon. They are aggregated, can arrive a day or two late, and recent days may change until Amazon settles them. Attrly shows them as Amazon reports them and does not guarantee their accuracy.
Accounts
- Keep your sign-in details secure and tell us right away if you think your account has been misused.
- Agencies control who in their organization, their brands and their creator roster can access their workspace, and are responsible for that access.
- You must be at least 18 and able to enter a contract to hold an account.
Your data
Each agency owns the data it brings to Attrly, including its Amazon data, brands, campaigns and creator information (“Customer Data”). The agency gives us permission to host and process Customer Data only to provide, secure and support the service. Our privacy policy explains how we handle it.
Agencies are responsible for having the rights and permissions needed to add Customer Data, including creators’ contact details, and for connecting only Amazon accounts they are authorized to use.
Amazon accounts and data
- Connecting an Amazon Ads account means you also remain bound by your own agreements with Amazon, including the Amazon Ads and Amazon Attribution terms.
- You may use Amazon data shown in Attrly only for your own advertising and creator programs, and only as Amazon’s terms allow.
- You can disconnect an Amazon account at any time. We will stop collecting its data and handle what we hold as our privacy policy describes.
Acceptable use
You agree not to:
- Break the law, Amazon’s policies, or the rights of others.
- Access accounts or data you are not authorized to access, or try to get around security or usage limits.
- Reverse engineer, scrape or overload the service, or use it to build a competing product.
- Use creator links to generate fake clicks, orders or other misleading activity.
- Upload malicious code or content you do not have the right to share.
We may suspend access that puts the service, other customers or Amazon data at risk, and will tell you why where we can.
Fees
Fees, billing terms and any trial are set out in your order form. Fees exclude taxes unless the order form says otherwise.
Confidentiality
Each side will protect the other’s non-public information with reasonable care and use it only for this relationship. Amazon data, including Attribution reports, is confidential to the brand that connected it.
Our property
Attrly, its software and its design belong to Attrly LLC. We give you a limited, non-exclusive right to use the service during your subscription. If you send us feedback, we may use it without obligation to you.
Independent of Amazon
Amazon and Amazon Attribution are trademarks of Amazon.com, Inc. or its affiliates. Attrly is an independent product and is not affiliated with, sponsored or endorsed by Amazon. Amazon may change or end its services, which can affect what Attrly can show.
Disclaimers
Except as stated in an order form, the service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not promise any particular sales or business result.
Limitation of liability
To the extent the law allows, neither side is liable for indirect, incidental, special, consequential or punitive damages, or lost profits or revenue. Each side’s total liability under these terms is limited to the fees paid to Attrly in the 12 months before the claim. These limits do not apply to a party’s indemnity obligations, breach of confidentiality, or amounts that cannot be limited by law.
Indemnity
Agencies will defend and indemnify Attrly against third-party claims arising from their Customer Data or their breach of these terms. Attrly will defend and indemnify agencies against third-party claims that the service, as we provide it, infringes their intellectual property.
Ending service
You can stop using Attrly at any time, subject to the term in your order form. Either side may end the agreement if the other materially breaches it and does not fix the breach within 30 days of notice. When service ends, you can request an export of your Customer Data within 30 days, after which we delete it as our privacy policy describes.
Governing law
These terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Disputes will be resolved in the state or federal courts located in California, and each side consents to their jurisdiction.
Changes
We may update these terms. We will change the date above and give customers at least 30 days’ notice of material changes. Continuing to use Attrly after that means you accept the update.
Other terms
If any part of these terms is unenforceable, the rest stays in effect. You may not transfer these terms without our consent, except as part of a merger or sale of your business. Not enforcing a term is not a waiver of it.
